Job Description
The Position
This role will serve as one of the legal counsels for Albemarle’s rapidly growing businesses and operations in China. This role will report to the Regional Counsel in China and will primarily be required to provide legal advice and support for all of Albemarle’s businesses in the region, including day-to-day legal matters in China, with a focus on procurement-related matters and labour law matters. The person selected for this role is expected to sit in Shanghai, China, together with other Albemarle China Law Group members.
Key Responsibilities
- Effectively collaborate with and serve as trusted advisor to the China business on a variety of legal, contractual and regulatory matters impacting the business
- Provide legal advice and support across all of Albemarle’s businesses in the region, while collaborating with other members of the Albemarle in-house legal team as appropriate
- Provide advice that is strategic, thoughtful, risk-adjusted and clear on matters of significant complexity and impact to Albemarle’s business in the region
- Communicate clearly and concisely, having the ability to translate complex matters into terms digestible by a wide range of audiences
- Support on projects, expansions, new investments and other matters
- Review, draft, and negotiate a broad range of significant and complex commercial contracts, including sales contracts, construction and capital projects related contracts, procurement agreements, services agreements, property lease agreements, confidentiality agreements, intercompany agreements and other contracts
- Assist in the development and refinement of standard template legal documentation for various contracting needs in China
- Responsible for claims prevention and management, as well as claims initiatives, with respect to commercial, employment matters, including pre-litigation dispute resolution matters as required
- Provide advice related to labour law matters and personal data protection related matters
- Effectively interface with other groups and functions within the business, including marketing, commercial, HSE, HR, manufacturing, supply chain, quality, compliance, government and regulatory affairs, communications, finance, tax, treasury, risk management, capital projects, engineering, etc.
- Effectively interface with and manage outside counsel as necessary
Work Experience / Technical Skill Requirements
- Law firm experience with in-house experience strongly preferred
- 5+ years experience with a broad-based generalist skillset and a wide range of commercial experience in China; broader APAC region experience a plus
- Experience in capital projects and contract negotiations and advising on regulatory, contractual matters required
- Experience in labour law matters with some personal data protection experience strongly preferred
- Experience with health, safety, environmental, government affairs matters
- Demonstrated and effective cross-functional and multi-jurisdictional collaboration
- Strong work ethic with the ability to work independently
- Strong written and verbal communication skills (both Chinese and English)
- Experience working in a matrix environment with a multinational corporation preferred
- Highest standards of ethics and professional integrity
Education / Qualification Requirements
- Law degree from a reputable University in China
- Passed Chinese bar examination
